These Terms of Service ("Terms") govern your use of the SEO, web design and advertising services provided by Featured ("Featured", "we", "us" and "our").By engaging or using our services, you agree to these Terms and the applicable service agreement.

1. Acceptance of These Terms

When you engage or use our services, you confirm that:

  • You have read, understood and agreed to be bound by these Terms and the applicable service agreement.
  • You have the legal capacity and, where applicable, authority to enter into the agreement.
  • All information you provide to us is true, accurate and complete.
  • You will comply with all laws and regulations that apply to your use of the services.

If you do not agree to these Terms, do not engage or use our services.

2. Our Services

Our services may include:

  • SEO services: Search engine optimisation, content strategy and marketing, technical SEO, and AI search optimisation (GEO).
  • Website design and development: Custom websites, WordPress, Wix and landing pages.
  • Digital advertising: Google Ads, Meta/Facebook Ads, Instagram, YouTube, TikTok and Xiaohongshu (RED) advertising.
  • E-commerce services: Shopify and WooCommerce store design, development and optimisation.

The scope, deliverables, fees and timetable for each project will be set out in the applicable service agreement.

3. Service Standards and Performance Limits

What we commit to:

  • Delivering the services with reasonable care, skill and professional diligence.
  • Working to the timelines agreed in the applicable service agreement.
  • Providing transparent performance reports and supporting data where reporting is included in the agreed scope.
  • Following generally accepted industry practices and ethical standards.

What we do not guarantee:

  • A particular position for any keyword, because rankings depend on search engines and other factors outside our control.
  • A particular amount or rate of traffic growth, unless a written traffic guarantee is expressly included in the applicable service agreement.
  • A particular conversion rate or other commercial result from an advertising campaign, because outcomes also depend on factors such as the offer, pricing and market.
  • Uninterrupted or unchanged performance following a search engine, advertising platform or third-party algorithm change.

Our performance focus is measurable organic traffic growth—not keyword rankings or other vanity metrics in isolation.

4. Payment and Refunds

Payment:

  • Fees, payment milestones and due dates will be set out in the applicable service agreement.
  • We accept bank transfer, cheque and any other payment method agreed by both parties.
  • All fees are denominated in Hong Kong dollars (HKD) unless the applicable service agreement states otherwise.

Refunds:

  • If work has not started, we may provide a full or partial refund after deducting any costs or commitments already incurred.
  • If work has started, any refund will take account of the work completed and costs or commitments incurred.
  • If our material breach prevents the services from continuing, we will provide an appropriate remedy or refund having regard to the circumstances.
  • A refund request must be made in writing and will be reviewed and resolved in consultation with you.

5. Client Responsibilities

To help us deliver the services as agreed, you will:

  • Provide the information, content, approvals and access we reasonably need within the agreed timescales, including access to relevant website and analytics accounts.
  • Ensure that the information and materials you provide are accurate and complete and that you have the right to provide and authorise our use of them.
  • Respond to reasonable requests and provide timely reviews, decisions and feedback.
  • Pay all fees by the applicable due dates.
  • Comply with all applicable laws, regulations and industry requirements.
  • Not use our services for any unlawful, fraudulent or harmful purpose.

We will not be responsible to the extent that a delay or failure is caused by your failure to meet these responsibilities.

6. Intellectual Property Rights

Rights we retain:

  • All intellectual property rights in our pre-existing or independently developed methods, tools, templates, know-how and proprietary technology remain ours.
  • With your prior consent, we may display or describe the work delivered to you in our portfolio or a case study.

Rights you retain or receive:

  • Subject to full payment, intellectual property rights in deliverables created specifically for you—such as approved website designs and copy—will transfer to you as set out in the applicable service agreement.
  • You retain ownership of the information, content, trade marks and other brand assets you provide to us.

The applicable service agreement will set out any project-specific intellectual property arrangements.

7. Confidentiality

We will:

  • Use reasonable care to protect the trade secrets and confidential or commercially sensitive information you provide.
  • Use your confidential information only as needed to provide the services or comply with legal obligations.
  • Not disclose your confidential information to a third party except as permitted below or as reasonably necessary to provide the services under appropriate confidentiality obligations.

These obligations do not apply where:

  • Disclosure is required by law, a court or a competent regulatory authority.
  • The information is already public, or becomes public other than through our breach of these Terms.
  • You have given us prior written consent to the disclosure.

8. Disclaimers and Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Subject to that, and to the maximum extent permitted by law:

  • Except for warranties expressly set out in these Terms or the applicable service agreement, the services are provided on an "as is" and "as available" basis.
  • We are not liable for indirect, incidental, special or consequential loss arising from the use of, or inability to use, the services.
  • We are not responsible for effects caused by search engine or platform algorithm changes, competitor actions, market conditions or other events outside our reasonable control.
  • We are not responsible for changes to, decisions by, or outages of third-party platforms such as Google, Meta or Shopify.

Subject to any liability that cannot lawfully be excluded or limited, our aggregate liability arising from the services will not exceed the total fees you paid under the service agreement giving rise to the claim.

9. Termination

Either party may terminate the services if:

  • The other party commits a material breach and does not remedy it within a reasonable period after receiving written notice.
  • The other party becomes insolvent, enters liquidation or is otherwise unable to continue operating.
  • The parties agree in writing to terminate the services.

When the services end:

  • Each party must settle all fees and other amounts due up to the effective date of termination.
  • We will hand over completed deliverables in accordance with the applicable service agreement and subject to payment of amounts due.
  • Any provision intended by its nature to survive termination—including provisions on confidentiality, intellectual property, liability and dispute resolution—will remain in effect.

10. Dispute Resolution and Governing Law

If a dispute arises, the parties will:

  • First try to resolve it through good-faith negotiation.
  • If negotiation does not resolve it, seek to resolve it through mediation.
  • If mediation does not resolve it, submit the dispute to the jurisdiction of the courts of Hong Kong.

These Terms are governed by the laws of the Hong Kong Special Administrative Region.

11. Changes to These Terms

We may update these Terms from time to time. If a change is material, we will give reasonable notice by email or a prominent notice on our website.

Where permitted by law, your continued use of the services after an updated version takes effect will constitute acceptance of the updated Terms. If you do not agree, please stop using the services, subject to any obligations in your existing service agreement.
